1. Agreement to these Terms
These Terms of Service are an agreement between you and Cosmic Jaunt, LLC ("Cosmic Jaunt," "we," "us," or "our"). By creating an account, using the Services, connecting a third-party account, publishing a website, or subscribing to a paid plan, you agree to these Terms.
If you use the Services for a business or organization, you represent that you have authority to bind that business or organization to these Terms.
2. Our Services
Cosmic Jaunt provides tools to create, preview, host, and publish websites. Depending on your plan and configuration, the Services may include AI-assisted website generation, editable website workspaces, SEO tools, forms and lead capture, managed hosting, SSL, custom domains, billing subscriptions, and Social Studio for social media content planning, generation, scheduling, and publishing.
We may improve, change, suspend, or discontinue parts of the Services over time. We will try to avoid changes that materially reduce paid features during a subscription period unless required for security, compliance, provider rules, or service reliability.
3. Accounts and Security
You are responsible for the information you provide, the activity in your account, and keeping your password secure. You must promptly notify us if you believe your account has been compromised.
You may not share access in a way that bypasses plan limits, impersonate someone else, use false contact information, or use the Services for unlawful or abusive activity.
4. Trials, Subscriptions, and Billing
Cosmic Jaunt may let you create, build, and preview before paying. Paid plans are used for features such as publishing, custom domains, hosting capacity, increased usage, Social Studio, or other paid capabilities shown at checkout.
Subscription billing is handled by our payment providers, such as PayPal or other payment processors we may support. We do not store full credit card or debit card numbers on our servers. Your payment provider may require its own terms and privacy policy.
Plan prices, limits, included features, trial periods, renewal timing, cancellation rules, taxes, and refund treatment are shown in the product or checkout flow. Unless required by law or stated otherwise at checkout, fees already paid are non-refundable.
5. Your Content and Websites
You retain ownership of the business information, prompts, copy, images, logos, files, website content, social posts, form submissions, and other materials you upload, generate, edit, or publish through the Services ("Customer Content").
You grant Cosmic Jaunt a limited license to host, copy, process, display, transmit, modify, and use Customer Content only as needed to provide, secure, support, and improve the Services, comply with law, and enforce these Terms.
You are responsible for ensuring your Customer Content, published websites, domains, forms, and social posts comply with applicable laws, industry rules, advertising rules, privacy obligations, intellectual property rights, and third-party platform policies.
6. AI-Assisted Output
The Services may use AI systems to help generate or revise websites, page copy, images, code, SEO metadata, social captions, schedules, or other content. AI output can be inaccurate, incomplete, similar to other generated content, or unsuitable for your specific legal, medical, financial, regulated, or professional use case.
You are responsible for reviewing and approving AI output before publishing or relying on it. You should not submit sensitive personal data, confidential business secrets, payment card data, health information, or other highly sensitive information into prompts unless you have confirmed that the feature is appropriate for that data.
7. Domains, Hosting, and Availability
Custom domain publishing may require DNS changes, third-party registrar settings, SSL issuance, and provider propagation outside our direct control. We may provide instructions and automation, but you remain responsible for ownership, renewal, and lawful use of your domains.
We work to keep hosted websites available, but we do not guarantee uninterrupted service. Maintenance, security events, provider outages, DNS issues, payment failures, abuse prevention, or third-party platform issues may affect availability.
8. Social Studio and Third-Party Platforms
If you connect social accounts, you authorize Cosmic Jaunt and Social Studio to access the selected accounts, pages, profiles, channels, tokens, permissions, media, and posting features only as needed to provide the features you choose, such as account connection, content creation, scheduling, analytics, and publishing.
We do not ask for or store your social network passwords. Social connections use authorization flows provided by the applicable platform where available. You can revoke access through Cosmic Jaunt, Social Studio, or the connected platform account settings.
Your use of connected platforms is also governed by those platforms' own terms, policies, rate limits, review requirements, and enforcement decisions. We are not responsible for a platform rejecting, removing, limiting, delaying, or suspending content, accounts, integrations, permissions, or apps.
9. Acceptable Use
You may not use the Services to create, host, publish, schedule, transmit, or promote unlawful, deceptive, infringing, harmful, hateful, abusive, exploitative, sexually explicit, spam, malware, phishing, credential-harvesting, surveillance, or privacy-invasive content.
You may not interfere with service operation, test or bypass security controls without written permission, scrape or overload the Services, resell the Services in violation of plan terms, or use the Services to violate third-party platform rules.
10. Intellectual Property
Cosmic Jaunt and its software, designs, branding, workflows, templates, interfaces, and documentation are owned by Cosmic Jaunt or its licensors and are protected by intellectual property laws. These Terms do not transfer ownership of our platform to you.
You may use the Services during your subscription or trial according to these Terms. You may not copy, reverse engineer, sell, sublicense, or create competing services using non-public parts of Cosmic Jaunt except where law expressly allows.
11. Privacy and Data Deletion
Our Privacy Policy explains how we collect, use, share, retain, and protect personal data. Our Data Deletion Instructions explain how to request deletion and disconnect third-party platform access.
By using the Services, you agree that we may process personal data as described in the Privacy Policy and as needed to provide the Services.
12. Suspension and Termination
You may stop using the Services at any time. You may cancel subscriptions through the account dashboard or the applicable payment provider flow where available.
We may suspend or terminate access if you violate these Terms, create security or legal risk, fail to pay required fees, exceed reasonable usage limits, or use the Services in a way that could harm Cosmic Jaunt, our customers, visitors, providers, or connected platforms.
13. Disclaimers
The Services are provided "as is" and "as available." To the fullest extent permitted by law, we disclaim implied warranties, including merchantability, fitness for a particular purpose, non-infringement, and uninterrupted or error-free operation.
We do not guarantee specific search rankings, conversion rates, sales, platform approval, social media reach, ad performance, domain propagation timing, AI output quality, or business results.
14. Limitation of Liability
To the fullest extent permitted by law, Cosmic Jaunt will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost revenue, lost data, business interruption, or reputational harm.
To the fullest extent permitted by law, our total liability for any claim relating to the Services is limited to the amount you paid to Cosmic Jaunt for the Services giving rise to the claim during the three months before the event giving rise to liability.
15. Changes to these Terms
We may update these Terms from time to time. If changes are material, we will take reasonable steps to notify users, such as posting an updated date, showing notice in the product, or sending email. Continued use after the effective date means you accept the updated Terms.
